These Terms and Conditions ("Terms") govern the use of the website located at flagstaffasphaltpaving.com and the services provided by Groundbreak Flagstaff Asphalt Paving ("Company," "we," "us," or "our"). By accessing our website or engaging us for services, you agree to be bound by these Terms. If you do not agree, do not use this site or engage our services.
By visiting this website, submitting a contact or estimate request, or entering into a service agreement with us, you confirm that you are at least 18 years old, have the legal authority to enter into contracts for the property in question, and agree to these Terms in full. If you are acting on behalf of a business or organization, you represent that you have authority to bind that entity.
Groundbreak Flagstaff Asphalt Paving provides asphalt paving, sealcoating, repair, resurfacing, parking lot maintenance, and related services for residential and commercial properties in the Flagstaff, AZ area and surrounding communities. The specific scope of work for each project is defined in a written estimate or service agreement provided before work begins. Services described on this website are for informational purposes only and do not constitute a binding offer.
All estimates are provided in writing and reflect the scope of work discussed at the time of the site visit. An estimate is not a binding contract until both parties have signed a written service agreement.
Estimates may be revised if conditions differ materially from what was observed during the initial assessment - for example, if excavation reveals unexpected subsurface conditions, if the project scope is changed at the customer's request, or if material costs change significantly between the estimate date and the scheduled work date.
We will notify you in writing of any pricing change before proceeding. You have the right to decline the revised estimate without penalty before work has begun.
Work is scheduled at a mutually agreed date and time. We reserve the right to reschedule due to weather conditions that would compromise the quality of the work, including rain, temperatures below safe application thresholds, or other conditions outside our control.
If you need to cancel or reschedule, please notify us as far in advance as possible. Cancellations made after materials have been ordered or equipment has been dispatched may result in a fee to cover those costs. The specific terms for deposits and cancellation fees are stated in your written service agreement.
We are not liable for delays caused by weather, material shortages, permit processing times, or other circumstances beyond our reasonable control.
Payment terms are specified in your written service agreement. Unless otherwise agreed in writing, payment is due in full upon completion of the project. Accepted payment methods will be stated in the agreement.
Deposits may be required on larger projects or when materials must be ordered in advance. The deposit amount and conditions for its refund or application toward the final balance will be stated in writing before you are asked to pay.
Invoices not paid within the agreed period may be subject to a late fee as stated in the service agreement. We reserve the right to pursue collection through lawful means for unpaid invoices.
You are responsible for:
We are not responsible for damage to underground utilities or structures that were not disclosed to us or that are not indicated by a utility locate service prior to excavation.
Any workmanship warranty we provide is stated in your written service agreement. Where a workmanship warranty is given, it covers defects in materials and installation under normal use conditions. It does not cover:
